These Terms of Service apply to your use of the Legendary Gemworks website and any purchase made through our online store. Legendary Gemworks is operated by Thomas Creative Ventures LLC.

By visiting our website, placing an order, or otherwise using our services, you agree to these Terms of Service and any policies referenced within them. Please do not use the website or place an order if you do not agree to these terms.

1. About Our Products

Legendary Gemworks creates handcrafted gemstone jewelry, collectible displays, art cards, and related accessories.

Many of our products are handmade using natural or semi-precious stones. Variations in color, clarity, pattern, texture, shape, and size are normal characteristics of these materials. Your item may not look exactly like the product photographed, but it will follow the same overall design and stone selection unless otherwise noted.

Small differences in spacing, bead placement, hardware, and construction may also occur because each piece is assembled by hand.

2. Product Information and Availability

We make reasonable efforts to keep product descriptions, photographs, prices, inventory, and availability accurate. However, occasional errors may occur.

We reserve the right to:

• Correct errors or incomplete information

• Update product descriptions or pricing

• Limit the quantity of an item available for purchase

• Discontinue or modify products

• Cancel an order affected by an inventory, pricing, or listing error

If we cancel an order after payment has been received, the affected amount will be refunded to the original payment method.

3. Orders and Payment

Submitting an order does not guarantee acceptance. All orders are subject to product availability, payment authorization, fraud review, and acceptance by Legendary Gemworks.

You agree to provide current, complete, and accurate billing, shipping, and contact information. We are not responsible for delays or losses caused by incomplete or incorrect information provided at checkout.

Payment must be received before an order is produced or shipped unless a separate written agreement has been made.

We may refuse or cancel an order when we reasonably believe it involves fraud, unauthorized payment, misuse of a promotion, an incorrect price, prohibited activity, or an unreasonable quantity intended for unauthorized commercial resale.

4. Production, Sizing, and Preorders

In-stock orders are generally processed within the timeframe listed in our Shipping Policy. Some pieces may require 1–3 business days of production, assembly, adjustment, or sizing before they are ready to ship.

Preorder items may require up to four weeks to produce and ship unless a different timeline is stated on the product page.

Customers requesting a custom bracelet size are responsible for submitting an accurate wrist measurement and fit preference. Additional fees may apply if an item must be resized because incorrect measurements were provided.

Production and shipping estimates are not guaranteed delivery dates.

5. Shipping and Delivery

Shipping options, processing timelines, transit estimates, tracking information, and international shipping details are described in our Shipping Policy.

Carrier delivery estimates begin after the package has been accepted by the carrier. Delivery may be affected by weather, customs processing, holidays, service interruptions, incorrect addresses, and other circumstances outside our control.

Although we cannot guarantee carrier delivery dates, we do not consider our responsibility to customers finished the moment a package ships. Please contact us if tracking indicates that an order is lost, damaged, significantly delayed, or delivered incorrectly so we can review the situation and determine the appropriate next steps.

Customers are responsible for reviewing and confirming their shipping address before completing an order. Additional shipping charges may apply when an order is returned because of an incorrect or incomplete address.

6. International Orders

International customers are responsible for following the import rules of their destination country.

Customs duties, VAT, import taxes, brokerage charges, and other government or carrier fees may be collected at checkout or charged separately upon delivery. Unless specifically stated at checkout, these charges are not included in the product price or shipping rate and are the responsibility of the recipient.

Customs inspections and local postal processing may delay delivery. Legendary Gemworks does not control these delays.

If an international package is refused, abandoned, or returned because import charges were not paid, any refund will be handled according to our Return Policy and may be reduced by nonrecoverable shipping, return, customs, or carrier expenses where permitted by law.

7. Returns, Exchanges, Repairs, and Defects

Eligibility for returns, exchanges, resizing, repairs, and defective-item claims is governed by our Return and Refund Policy.

Unless otherwise required by law, customers must contact us within the stated return window and return eligible merchandise in like-new condition.

Custom-sized, personalized, commissioned, altered, final-sale, or made-to-order merchandise may have different return restrictions. Any applicable restriction will be disclosed in the product listing, order agreement, or Return and Refund Policy.

Nothing in these terms is intended to remove or reduce consumer rights that cannot legally be waived.

8. Jewelry Care and Safety

Gemstone jewelry should be treated with reasonable care. Exposure to water, pools, chemicals, impact, excessive stretching, and improper storage can damage beads, finishes, elastic, and hardware.

Normal wear, accidental damage, loss, improper care, and damage caused by modification or misuse are not considered manufacturing defects.

Our jewelry and displays may contain small parts and are not toys. Keep them away from young children and pets when they could present a choking or ingestion hazard.

Customers are responsible for determining whether product materials are appropriate for their own allergies, sensitivities, or intended use.

9. Promotions and Discounts

Promotional offers are subject to the conditions stated when the promotion is announced.

Unless otherwise stated:

• Promotions have no cash value

• Discounts cannot be applied retroactively

• Offers may not be combined

• Free items are available only while supplies last

• Discount codes may be limited to specific products, customers, dates, or order values

We reserve the right to cancel or correct a promotion affected by an error, technical issue, fraud, or misuse.

10. Intellectual Property

The Legendary Gemworks name, logos, branding, original product photography, written content, card layouts, website graphics, and original creative materials are owned by Thomas Creative Ventures LLC or used with permission.

You may not copy, reproduce, modify, distribute, sell, publish, scrape, or commercially use our protected content without prior written permission.

Third-party names, trademarks, characters, artwork, and other intellectual property referenced on our website remain the property of their respective owners. References to third-party properties do not imply sponsorship, affiliation, licensing, or endorsement unless expressly stated.

11. Customer Submissions

When you send us a review, photograph, video, testimonial, design request, or other content, you retain ownership of your original material.

We will not use privately submitted customer photographs or videos for public marketing without permission. When you give us permission to repost or feature submitted content, you grant Legendary Gemworks a nonexclusive, royalty-free permission to display, reproduce, crop, format, and share that content for the agreed promotional purpose.

You represent that you have the right to submit the content and that our permitted use will not violate another person’s rights.

12. Website Use

You may not use our website or services to:

• Violate applicable laws or regulations

• Submit false, fraudulent, or misleading information

• Attempt to access another person’s account or payment information

• Introduce malicious code or interfere with website security

• Scrape, copy, or harvest website content without authorization

• Use the website in a way that harms Legendary Gemworks, Shopify, our customers, or another party

We may restrict or terminate access when we reasonably believe these terms have been violated.

13. Third-Party Services and Links

Our store is hosted through Shopify and may use third-party services for payment processing, shipping, analytics, marketing, reviews, and other store functions.

Third-party services may be governed by their own terms and privacy practices. We are not responsible for the content, availability, or practices of websites and services we do not own or control.

14. Disclaimer of Warranties

We make reasonable efforts to accurately describe our products and provide them in good condition.

Except for warranties expressly stated in our product listings, Return and Refund Policy, or other written policies, the website and services are provided on an “as available” basis to the fullest extent permitted by law.

Nothing in these terms excludes warranties, guarantees, remedies, or consumer protections that cannot legally be excluded.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Legendary Gemworks and Thomas Creative Ventures LLC will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of our website, services, or products.

Where liability cannot be excluded, our total liability relating to a particular order will not exceed the amount paid for the product or order giving rise to the claim, except where applicable law requires otherwise.

Nothing in these terms limits liability that cannot legally be limited or excluded.

16. Events Outside Our Control

We are not responsible for a delay or failure caused by circumstances reasonably outside our control, including severe weather, natural disasters, carrier disruptions, customs delays, labor interruptions, supply shortages, government action, utility outages, internet failures, or payment-network disruptions.

When possible, we will communicate significant delays and work toward a reasonable solution.

17. Governing Law

These Terms of Service and transactions conducted through our website are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

This section does not remove any mandatory consumer protections that may apply based on a customer’s location.

18. Severability and Waiver

If any part of these terms is found to be invalid or unenforceable, the remaining sections will continue to apply.

A failure by Legendary Gemworks to enforce a provision does not waive our right to enforce it later.

19. Changes to These Terms

We may update these Terms of Service as our products, services, or legal obligations change.

The updated version will be posted on this page with a revised effective date. Changes apply to future use of the website and future orders unless otherwise required by law.
